[edit] Summary

This work is a copyrighted publicity photograph. It is believed that the use of some such photographs to illustrate:

the person(s), product, event, or subject in question where the image is unrepeatable, i.e. a free image could not be created to replace it on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation, qualifies as fair use under United States copyright law.

Other use of this image, on Wikipedia or elsewhere, might be copyright infringement. See Wikipedia:Fair use and Wikipedia:Publicity photos.

Additionally, the copyright holder may have granted permission for use in works such as Wikipedia. However, if they have, this permission likely does not fall under a free license. As well, commercial third-party reusers of this image should consider whether their use is in violation of the subject's publicity rights, if the photograph is of a person.

To the uploader: This tag should only be used for images of a person, product, or event that is known to have come from a press kit or similar source, for the purpose of reuse by the media. Please add a detailed fair use rationale as described on Wikipedia:Image description page, as well as the source of the image, the photographer, and copyright information. Additionally, if the copyright holder has granted permission, please provide further details as to the terms.

Please note that our policy usually considers fair use images of living people that merely show what they look like to be replaceable by free-licensed images and unsuitable for the project. If this is not the case for this image, a rationale should be provided proving that the image provides information well beyond simple identification or showing that this image is exceptionally difficult to replace by a free-licensed equivalent.

______________________________________ADDENDUM__________________________________________________ Due to the long-standing personal friendship I have with the subject, (California Poet Laureate, Wilma Elizabeth McDaniel) I have been asked by previous contributors to submit materials that I have come into possession of, mostly from Ms. McDaniel herself, and with her complete trust and permission to share with (her exact words) "...anyone who has a genuine interest in the Okie experience." This photo of Ms. McDaniel includes a credit to the photographer. However, the image quality of the photocopy it is taken from, as submitted by myself, is far too degraded and grainy to make out clearly. This photo was included in an interview with Ms. McDaniel by Joan Jobe Smith, entitled: "The Almost-Interview of Wilma E. McDaniel". There is an inscription by Ms. McDaniel in the upper right-hand corner of the photocopy that says "Chiron Review, Autumn 1999". Due to her declining health issues, even at the time of this inscription, I cannot positively verify the accuracy of this publishing date. I do have a current request in with (now defunct!) 'Chiron Literary Review' Editor/Publisher, Michael Hathaway, to possibly provide as much available materials as he might be willing to, for inclusion to the Wikipedia - Wilma Elizabeth McDaniel project, now in progress. Of cousre, he will receive full credit and heartfelt thanks for any and all contributions, as will any other source that provides materials for this worthwhile "labor of love". Thanks to Wikipedia staff for all of their diligent and thoughtful re-formatting and/or other assistance with this effort. Sincerely,

Pat 'the Hat' Goodrich Performing Songwriter Audio Archivist for Wilma E. McDaniel 12/5/2006 Nashville, TN

[edit] Licensing

This image was uploaded under a fair use rationale, but may fail Wikipedia's first fair use criterion in that it illustrates a subject for which a free image might reasonably be found or created that adequately provides the same information. If you believe that a free replacement image can not be reasonably found or created, please add the following to this page:

{{Replaceable fair use disputed}} and give the reasons for your dispute on the talk page.
Possible reasons include the individual being a recluse or the photo being used to illustrate a particular point in the person’s career.

If this image is determined to be replaceable within one week from (6 December 2006) (13 December), the image may be deleted by any administrator. Do not remove this tag.

It is disputed whether or not this image violates our first fair use criterion.

The reason given is: SEE Previous addendum

Closing administrator: if the decision is to Keep the image please put
