[edit] Rationale of fair use for Red Skull and Captain America (1991 film)

The image Image:Redskull.jpg is being linked here; though the picture is originally copyright, I (Lajbi Holla @ meWho's the boss? 12:33, 4 June 2006 (UTC)) feel it is covered by fair use because:

  1. The image is a screenshot of TV-movie originally created by 21st Century Film Corporation, and intended for wide distribution (released in VHS by Columbia TriStar).
  2. The screenshot is of lower resolution and quality than the VHS film.
  3. No free or public domain images have been located for the VHS.
  4. The screenshot does not limit the copyright owners' rights to distribute the TV movie of VHS in any way.
  5. The screenshot is intended to represent the VHS of Captain America and Scott Paulin in person.
  6. The screenshot is being used for informational purposes only, and its use is not believed to detract from the original VHS or the TV movie in any way.
  7. Screenshots, posters and covers were presented in various websites (like www.beyondhollywood.com).

[edit] Licensing

Copyrighted

This image is a screenshot from a copyrighted film, and the copyright for it is most likely owned by the studio which produced the film, and possibly also by any actors appearing in the screenshot. It is believed that the use of a limited number of web-resolution screenshots

qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Fair use for more information.

To the uploader: please add a detailed fair use rationale for each use, as described on Wikipedia:Image description page, as well as the source of the work and copyright information.
