I (User:Caper13) believe that the use of this image to illustrate the image of Matt Drudge in this article is fair use under U.S. copyright law because:

• It is used solely for the purpose of illustrating the subject of the article
• These articles would be deficient without an illustration of this person
• No freely licensed alternative is available for this purpose
• The image is of low resolution and so does not diminish the copyright holder's ability to profit from images of this artwork
• The material has previously been published on the copyright holders website and specifically offered for download to allow others to publicize the likeness of the subject of the photo.
• In relation to the previous item, the image use in the article is consistent with the purposes intended by the copyright holider
• The material must contributes significantly to the article as no other image of Matt Drudge is in the article.
• I and others have searched for a freely licensed image of the subject of this article and have been unable to find one. We will continue to search and replace this fair use image when a free one becomes available. This image's use is intended to be temporary. Caper13 01:04, 4 December 2006 (UTC)
