[edit] Fair use rationale

The image linked here is claimed to be used under fair use because:

  1. It is an historically significant photograph of TE Lawrence. He had a motorcycle accident which led to his death.
    Please, elaborate on that.
  2. It is likely to have been taken on delivery of one of Lawrence's new Brough Superior's
    "Likely" is not strong enough.
  3. It is dated around the time of the publication of Lawrence's writing "Revolt In The Desert", when a large number of publicity photographs were taken
    Not a fair use argument
    Why? It's a publicity shot, which is fair use! - Trident13 14:55, 5 August 2006 (UTC)
It's likely PD but most publicity shots aren't fair use unless it was release in a press kit by the person, which seems unlikely. Jaranda wat's sup 18:31, 5 August 2006 (UTC)
  4. It is of much lower resolution than the original (copies made from it will be of very inferior quality)
  5. The photograph is only being used for informational purposes
    Not a fair use argument.
  6. It is already displayed on the Dutch Wiki page
    Not a fair use argument.

The original can be found, amongst many other places, at: http://www.britishartists.co.uk/david%20langford/lawrence_2.htm

The series of publicity shots, taken before he left for India, can be found at: http://www.telstudies.org/gallery/photos/1922-35/l4009.htm

Copyright is claimed to be owned by the Bodleian Library, their reference - (MS. Res.c.54)

  1. It is likely that the copyright is expired. Copyright law in England provides for a limit of 70 years. Anything produced or published before 1936 would no longer be protected. --Blue Tie 15:45, 2 August 2006 (UTC)
I agree it's likely PD those images. Jaranda wat's sup 18:31, 5 August 2006 (UTC)
