It is used for a non-commercial and educational purpose.
It is representative of Jimmy Dorsey- in fact, it is a publicity photo created expressly for publicizing Jimmy Dorsey.
There is no public domain photo available of Jimmy Dorsey. He became famous well after 1923 and he died in 1957 (and so it is not possible to take a photo of him).
It should not affect the commercial viability of the copyright.
