Description

This image of Jasmine Richardson was released on April 23, 2006 when the Richardson murders occurred, and her whereabouts were unknown. Police were seeking the public's help in finding her. Not a suspect at the time, the media freely and legally released the photo and her name. On April 24, she was designated a suspect, arrested, and her name/image was withdrawn (persuant to Canada's Youth Criminal Justice Act).

  • Fair use is justified as this is a highly publicized image (or was on April 23). No possible commercial threat exists to copyright holder, as the image has never been used for any commercial purposes. The image, for a brief time, was widely distributed, and central to a major media event. The existence of the image, and moves to suppress it, are a significant part of the content of the Richardson family murders article. This is similar to other articles, where controversy surrounds the publication of an image, and the image itself, is therefore central to the story, and should be shown to illustrate what's being suppressed. This image is widely available on the internet, so we are not revealing anything private. As the Youth Criminal Justice Act only applies to Canada, it is believed the use of this image is legal in the U.S. and specifically in Florida, where the Wikipedia servers are located.
