James_Smith_OU.jpg (62KB, MIME type: image/jpeg)

James Smith (musician) from band Underoath. It is a cropped image taken from a promotional wallpaper. The wallpaper can be downloaded off Underoath's official website that was used to promote their new CD Define the Great Line. Because no other pictures of quality could be found to represent the subject, the cropped picture is used.

[edit] Fair use rationale:

1. It is an image published for promotional reasons.
2. The image is not likely to replace the original market role of the original copyrighted media, or undermine the ability of the copyright holder to profit from their work.
3. The image is low-resolution and not likely to be used for piracy.
4. The image has previously been published at the stated source website.
5. The image is encyclopedic, and otherwise meets general Wikipedia content requirements, and is not used as decoration.
6. The material identifies the subject of the articles which it is used in (basist James Smith), and does not serve a purely decorative purpose. The image or media description page contains: Proper attribution of the source of the material (in the Summary section);

Copyrighted

This is a copyrighted image that has been released by a company or organization to promote their work or product in the media, such as advertising material or a promotional photo in a press kit.

The copyright for it is most likely owned by the company who created the promotional item or the artist who produced the item in question; you must provide evidence of such ownership. Lack of such evidence is grounds for deletion.

It is believed that the use of low-resolution images of promotional material

  • to illustrate the work or product being discussed;
  • where the image is unrepeatable, i.e. a free image could not be created to replace it;
  • on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation,

qualifies as fair use under United States copyright law. Other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Copyrights for more information.

To the uploader: please add a detailed fair use rationale for each use, as described on Wikipedia:Image description page, as well as the source of the work and copyright information.
