Rationale: The photo is used to show that the Indian troops indeed captured one of several peaks in the Kargil War. I have requested permission from the copyright holders to release it under either a free licence or to grand free use in Wikipedia. Though the images are not in public domain the Indian Information Act states that they can be used to dissipate information. Therefore this image is in fair use since it shows an essential part of the war, i.e reclaiming of the heights and a visible evidence goes a long way in achieving that. Further, this is the only image used in the article showing Indian soldiers.
