[edit] Summary
[edit] Fair use rationale for use in the article Frank Finlay
1. Image is used for the identification of the subject. 2. The image is a promotional picture issued by the person or the studio, as witness the signature of the subject and is readily available on the source website, and the further use of this image on Wikipedia is not believed to disadvantage the copyright holder. 3. The subject of the photograph is living, however a modern image of this person would not convey the same information. An image of this person at the time of her notability is more representative, and this image cannot be suitably replaced with an equivalent modern image. 4. A free image has not yet been located for this person.Orbicle 11:53, 8 December 2006 (UTC)
This work is a copyrighted publicity photograph. It is believed that the use of some such photographs to illustrate:
- the person(s), product, event, or subject in question
- where the image is unrepeatable, i.e. a free image could not be created to replace it
- on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation,
qualifies as fair use under United States copyright law.
Other use of this image, on Wikipedia or elsewhere, might be copyright infringement. See Wikipedia:Fair use and Wikipedia:Publicity photos.
Additionally, the copyright holder may have granted permission for use in works such as Wikipedia. However, if they have, this permission likely does not fall under a free license. As well, commercial third-party reusers of this image should consider whether their use is in violation of the subject's publicity rights, if the photograph is of a person.
To the uploader: This tag should only be used for images of a person, product, or event that is known to have come from a press kit or similar source, for the purpose of reuse by the media. Please add a detailed fair use rationale as described on Wikipedia:Image description page, as well as the source of the image, the photographer, and copyright information. Additionally, if the copyright holder has granted permission, please provide further details as to the terms.
Please note that our policy usually considers fair use images of living people that merely show what they look like to be replaceable by free-licensed images and unsuitable for the project. If this is not the case for this image, a rationale should be provided proving that the image provides information well beyond simple identification or showing that this image is exceptionally difficult to replace by a free-licensed equivalent.
[edit] Licensing
This image was uploaded under a fair use rationale, but may fail Wikipedia's first fair use criterion in that it illustrates a subject for which a free image might reasonably be found or created that adequately provides the same information. If you believe that a free replacement image can not be reasonably found or created, please add the following to this page:
If this image is determined to be replaceable within one week from (8 December 2006) (15 December), the image may be deleted by any administrator. Do not remove this tag.

It is disputed whether or not this image violates our first fair use criterion. See the talk page for details. Closing administrator: if the decision is to Keep the image please put {{Rk}} on the image page. If the decision is to Delete please archive the discussion on the talk page between {{Rtd}} and {{Rb}} and delete the image page. |
