It is asserted that the use of this image on Fianna Fáil qualifies as fair use for the following reasons:
- It is a low-resolution copy of the logo;
- It does not affect the market for the original work — this is a logo created to promote a political party, not a commercial work sold to the public for profit;
- By the nature of the image, no free alternative is possible;
- The logo is widely identified with FF via posters, election literature, advertisements etc. and so the inclusion of the logo adds significantly to the article
