E.T. levitating out of one of the many wells in the game. The other object pictured is a phone piece. The icon on the top bar of the screen shows what action can be taken by pressing the controller button (in this case, levitation).

It is believed that this image failed under being fair use for the following reasons:

Atari has not released any screenshots into the public domain;
It serves to illustrate the game in question;
It serves to identify E.T., a well, a phone piece, and the action icons;
It is of low quality;(due to the sheer awfulness of the game in question)
The image does not limit the copyright owners' rights to distribute the video game in any way;
The image is being used for informational purposes only;
Its use is not believed to detract from the original game in any way;
Its use does not infringe on Atari's ability to sell the game, which is old and hasn't been sold by Atari in decades.
Atari doesn't want it and has dumped in into a landfill. That's sorta like giving up copyright.
