Stainless Steel Studios (now defunct) has not released any such image into the public domain.
The image shows what the actual in-game experience from a player's point of view is.
The image is being used in an informative way and should not detract from the game.
The image's only purpose is to decribe Empires: Dawn of the Modern World, and no other purpose.
The image does not hamper Stainless Steel Studios's (or Activision's, their publisher) ability to sell the game.
