I have reluctantly created this page per [1] following long, ongoing discussions regarding the status of Image:Corpus Christi, Texas flag.svg and related discussions. It is my intention to review each of these images for their status with regards to Wikipedia policies in so far as fair use vs. free license issues are concerned and other related issues.

At this time, it is unclear what permissions User:Husnock has asked of the various agencies which hold copyrights to these images. I have thrice requested this clarification. Further, a number of errors have been made in the tagging of these images.

The expected course of action here is:

  1. Review each of these images with respect to their licensing status.
  2. In cases where their status is improper, change their tagging to one inline with Wikipedia policies.
  3. In cases where it is in doubt as to their status with regards to permissions asked for and received by User:Husnock, change their tagging to one inline with Wikipedia policies and:
    1. Inform Husnock of each of these images (as one message containing links to all the images) and request he provide permissions received from copyright holders to m:OTRS.
    2. Allow the OTRS team to appropriately retag images as warranted by permissions received.
  4. Remove any images not tagged with a free-license tag from any non-main namespace pages on Wikipedia.
  5. As time permits, review other image contributions of Husnock to correct other errors as found.

[edit] Nature of page

I want to make it absolutely clear in every way imaginable that this page is not a personal attack. This is a work space for me to conduct work I feel important to clarify copyright issues regarding a particular user's contributions. While large in scale, it is no different than my checking of any other user's image contributions, which I have done on innumerable occasions. It is not a comment on this user's contributions outside of the images listed here.

Further review is needed on these images to determine their status. Has permission been requested? What permissions were asked for? Has the permissions request and its response been sent to m:OTRS? Until the permissions asked for have been clarified and filed with OTRS, then the images are not available under a free license and should be tagged as fair use.

I've asked for clarification on what permissions Husnock received re: this image. This is the image that I used as a test case. Despite repeated requests, Husnock has not provided this information, nor provided a means to contact the copyright authority whom he contacted. I e-mailed the City of Corpus Christi on 16 November 2006. Specifically, I contacted Armando Chapa (armandoc@cctexas.com) and Mary Juarez (maryj@cctexas.com) at the City Secretary's office. To date (21 November 2006) I've not received a response.
Husnock has indicated that the publisher released rights to use on Wikipedia. This is against policy, as it must be fair use or free license. Further, the tag on the image is incompatible with the release.
Less clear; based on other edits this image could be "permission only". Unknown. Contact information for copyright holder needs to be presented, as well as release request and what was received presented to m:OTRS. Husnock has not, despite repeated requests, answered whether permissions to use on Wikipedia were asked or if free license permissions were asked. Regardless, information should be presented to OTRS.
Husnock changed the tag from {{seal}} to {{norightsreserved}} based on claim in text of image page that since its owned by a municipal government it is automatically public domain. This is false. This applies, in the U.S., to federal images only.

FROM HUSNOCK': According to the JAG Office of CNFJ, that is not correct. The United States Navy owns the rights to that image (and others) transfered to it under the clauses of various agreements and treaties with Japan (Korea has similar laws but that is a separate issue). Full contact info for the Japanese Foreign Ministry is provided on the talk page of this article and numbers can also be provided for the Commander's Officer of Naval Forces Japan and the regional JAG Office if there is still any doubt.
Note existence of Image:PrefSymbol-Osaka.png, which was deleted from ja.wikipedia.org for copyright/trademark concerns.

    • According to both the Public Affairs Officer and Staff JAG Officer of Commander Naval Forces Korea, those images were transferred to the total custody of the United States navy and can be redistributed as public images. Researching an exact phone number for people to call, but CNFK can be easily googled on the net.

Tagged as {{PD-USGov-NARA}}. However, College Park retains rights and NARA can not release them.
FROM HUSNOCK: A direct statement from the Archivist of the United States is that the image in question is property of NARA, transferred from College, Park with all rights reserved. This can be verified by calling 314-801-0800.

FROM HUSNOCK: The Public Affairs Office of the Pentagon states that they own the image, transferred from the city and therefore redistributed as a Federal wok. Phone numbers and e-mails of several Pentagon officals can be provided to verofy this.

These images have been reviewed and are at the core of the problem. These images are believed to have been obtained for use on Wikipedia under a permission to use on Wikipedia basis, which is against policy. In most cases, these images need to be changed to a fair use status, and Husnock informed so that he can convey any free license permission letters received from the respective copyright holders to m:OTRS and allow OTRS to retag the images appropriately.

Many of these images are using the deprecated {{pd}} tag. Quite a number of these images are unused. A route to go might be to simply delete the unused images through an IfD (no speedy class applies).

  • Image:EntCrewmanStripe.jpg (5/2/2005) Paramount retains rights to rank insignia they created for their own show. A recreation counts as a derivative work.
  • Image:SFLT.jpg (2/5/2006) Same as Image:EntCrewmanStripe.jpg
  • Image:EntLTJG.jpg (4/13/2005) - uncertain here; I believe this is an attempt to create a representation of a Star Trek Enterprise rank. As it's not used in any articles, I can not confirm this. If it is, and it's a derivative work or copy work, then Paramount retains rights. (unused)

  • On 14 February 2006, Husnock created {{PD-StarTrekRank}}, claiming that Paramount had released most Startrek rank insignia into the public domain. However, no proof of this was provided and the template was deleted 1 September 2006 (Wikipedia:Templates_for_deletion/Log/2006_September_1#Template:PD-StarTrekRank). See [2]
    • From Husnock: It should be noted that this template was deleted by a single "speedy delete" vote when User:Husnock was out of the country (USA) and had no time or oppurtunity to investigate the situation.


[edit] Miscellaneous notes

  • User:Husnock/Travel:
    • On 22 January 2006, User:Gmaxwell blanked the page for fair use violations tagging it as {{copyvio}} [3]. Husnock reverted 36 minutes later [4].
    • On 23 July 2006, Image:Us-ma-bo.png was removed by User:Bkell as a fair use violation [5]. Five days later, Husnock restored the image [6].
    • On 24 August 2006, User:Durin removed a large number of fair use violations from the page [7]. Near two hours later, Husnock reverted [8].
    • There were a number of other removals / reverts to this page after this point, but as a result of discussion from this point forward additions and removals were considerably more in line with fair use policy.
      • From Husnock: User:Husnock has since removed this page from Wikipedia since it was at the core of User:Durin's campaign of image removal and was creating a large amount of discord. The information on the page is at present reflected in an undiscolosed off-wiki website.
      • From Durin: The page was not at the core of the dispute. The core of the dispute are the images which are listed on this page. Removal of Husnock's travel page does nothing to alleviate the concerns regarding the status of the images.
  • Husnock has on several occasions referred to a discussion regarding the use of city flags on non-main namespace pages. Some or all of this discussion may be located at Wikipedia:Administrators'_noticeboard/IncidentArchive70#User:Gmaxwell_and_copyright_notices and User_talk:Husnock/Archive_4#Flag_images_question. Later, Husnock indicated that such an exception should exist [9].
