Purpose and character of the use: Informational use: illustrates the article on Daphne Rosen.
Nature of the copyrighted work: B/W frontal head shot. A hi-res version of this photo has been published previously on the WWW as part of a "portfolio".
Amount used: Thumbnail, the resolution is such that it is unlikely that it could be used for serious print publications.
Effect of the use on the potential market or value of the image: Probably none. The image is one of very few "decent" shots of Daphne Rosen; I would think that her porn images take the lion's share of the "Daphne Rosen images"-market. Also see (3).
