it does not limit the copyright owner's rights in any way
it is being used as part of a news report or comments about an accident which immediately followed the depicted boarding
it is not available in any other form, free or otherwise
the depicted photo significantly contributes to the article in showing the accident aircraft and the boarding of some of the 46 American students who perished on the flight
