[edit] Licensing
This is a copyrighted image that has been released by a company or organization to promote their work or product in the media, such as advertising material or a promotional photo in a press kit.
The copyright for it is most likely owned by the company who created the promotional item or the artist who produced the item in question; you must provide evidence of such ownership. Lack of such evidence is grounds for deletion.
It is believed that the use of low-resolution images of promotional material
- to illustrate the work or product being discussed;
- where the image is unrepeatable, i.e. a free image could not be created to replace it;
- on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation,
qualifies as fair use under United States copyright law. Other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Copyrights for more information.
To the uploader: please add a detailed fair use rationale for each use, as described on Wikipedia:Image description page, as well as the source of the work and copyright information.
[edit] Rationale of fair use for Katie Holmes
The image Image:CreekPromoHolmesJackson.JPG is being linked here; though the picture is originally copyright, I (Extraordinary Machine 18:37, 20 February 2006 (UTC)) feel it is covered by fair use because:
- The image is a publicity still originally created by Columbia Tri-Star Television and the WB Television Network, and intended for wide distribution.
- No free or public domain images have been located for the subject of the article or the television series.
- The image does not limit the copyright owners' rights to distribute the television series in any way.
- The image is intended to represent the subject in arguably her most well-known and widely-seen role as of writing. Its inclusion in the article is important because it represents a significant point in the subject's career that is discussed extensively in the article. Additionally, the image accompanies discussion included in the article of the subject's relationship with the other person in the photograph.
- The image is being used for informational purposes only, and its use is not believed to detract from the original television series in any way.
