Chelsy Davy - extract of an image published in the Mail on Sunday (a UK newspaper), 19 December 2004 and subsequently reproduced on various websites. Fair use claimed for the Whites in Zimbabwe article on the following rationale :

(1) The use of the image is to stimulate creativity for the enrichment of the general public. It is for a nonprofit, educational purpose. The article is on the subject of white Zimbabweans and the subject of the image is a prominent white Zimbabwean

(2) The image is of a factual and nonfictional nature and it has previously been widely published and circulated

(3) The image used is an extract from a larger image which was circulated by the copyrightholder two years ago

(4) This present use of the image has no impact on the image's marketability or sales value. It is an obsolete newspaper photograph.
