  1. No free equivalent is available or could be created that would adequately give the same information.
  2. The photo is not used in a mannar that would replace the original market role of the original copyrighted media.
  3. Image is of lower resolution than the original.
  4. Photo has been previously published.
  5. Photo is encyclopedic.
  6. Photo meets media-specific policy requirements.
  7. Photo is being used in at least one article.
  8. Inclusion of this photo adds greatly to the article, as it pictures the subject which the article is about.

This image is claimed for fairuse for wikipedia as it is being used strickly for purposes about the subject pictured. And its use on wikipedia is intended to add to the article as it displays a picture of the subject with which the article is about. There are no known alternatives available, as the subject passed away in 1991. Use of this photo does not detract from the original licenced owners in anyway, as its use is strickly for educational purposes, and is at a reduced quality from the original.
