I believe this image is irreplaceable because no free use image exists of Nichols. I have emailed his publicity agents to ask for a free photo, but they have not replied. The only fan who could potentially supply such images is fairly adamant on her website that she owns the copyright to those images and will nto give them up. The image is an image specifically taken as a publicity photo, and as such I believe is the best photo under Fair Use. Dev920 (check out this proposal) 19:40, 7 November 2006 (UTC)
- Our fair use policy forbids using a non-free image if a free image could be created that could be used in its place. See criterion #1 and counter-example #8. In this case, it would be possible to create a free image; therefore this non-free image may not be used. - There are ten points an image must meet to qualify under Fair Use:
1. No free equivalent is available or could be created that would adequately give the same information. 2. The image was originally a publicity photo - it is being used for that exact same purpose. 3. The image is of low quality. 4. The image may be found on imdb.com 5. The image is encyclopedic and otherwise meets general Wikipedia content requirements. 6. The material meets the media-specific policy requirements. 7. The material is used in Austin Nichols. 8. The material identifies the subject of the article. 9. The image is used only in the article namespace.

- It fails #1 -- someone could take a photograph of this person and license it freely -- and #10 -- properly attributing the copyright holder. Jkelly 23:44, 17 November 2006 (UTC)
