Originally taken on February 18, 2004 by Lupo from a press kit at [1], where a 533×827px, 300dpi version was available. Unfortunately, that site of some Norwegian concert agency or some such seems to be defunct now (Sept. 23, 2005). Photographer: Tonu Tormis.
This is a copyrighted image that has been released by a company or organization to promote their work or product in the media, such as advertising material or a promotional photo in a press kit.
The copyright for it is most likely owned by the company who created the promotional item or the artist who produced the item in question; you must provide evidence of such ownership. Lack of such evidence is grounds for deletion.
It is believed that the use of low-resolution images of promotional material
- to illustrate the work or product being discussed;
- where the image is unrepeatable, i.e. a free image could not be created to replace it;
- on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation,
qualifies as fair use under United States copyright law. Other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Copyrights for more information.
To the uploader: please add a detailed fair use rationale for each use, as described on Wikipedia:Image description page, as well as the source of the work and copyright information.
This work is copyrighted and unlicensed. It does not fall into one of the blanket fair use categories listed at Wikipedia:Fair use#Images or Wikipedia:Fair use#Audio_clips. However, it is believed that the use of this work in the article "Arvo Pärt":
- To illustrate the object in question
- Where no free equivalent is available or could be created that would adequately give the same information
- On the English-language Wikipedia ([2]), hosted on servers in the United States by the non-profit Wikimedia Foundation ([3]),
qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Fair use and Wikipedia:Copyrights.
To the uploader: this tag is not a sufficient claim of fair use. You must also include the source of the work, all available copyright information, and a detailed fair use rationale.
[edit] Fair use rationale
Use of this image in the article on Arvo Pärt is contended to be fair use. Rationale:
- Purpose and character of the use: Educational use: illustrates the article on Arvo Pärt, which should be compatible with a photo distributed in a press kit.
- Nature of the copyrighted work: Color photograph, published on the WWW as part of a press kit.
- Amount used: Low-resolution thumbnail, suitable for web use, but not for print publication.
- Effect of the use on the potential market or value of the image: probably next to none, given that it is a low-res thumbnail of a publicity image.
